PAC France SAS and its affiliates are committed to protecting your information. Please read the Privacy Policy (“the Policy“) carefully as it sets out important information relating to how are handled your personal information.

1. Presentation of the site.

  • Create, activate and use a PAC user account and/or license;
  • Express an interest in or have signed up for our conferences or products, including newsletters, apps, extensions, webinars, and e-books;
  • Register for, and attend a virtual or in-person PAC conference; or
  • Visit our websites (including our public and/or member-based websites) or social media sites, or use one of our mobile applications.

The Policy also applies to information we collect from you via our survey or diagnostic tools, as outlined in more detail below. You may be shown an additional confidentiality notice before participating in a survey or diagnostic. Please note that in cases where the terms of any such survey- or diagnostic-specific confidentiality notice conflict with any terms in the Policy, the terms of that notice will take precedence over the terms in the Policy. We will not use the information we collect via our survey or diagnostic tools to contact you for marketing purposes.

This site is always normally accessible to users. However, PAC GROUP may decide to interrupt the site for technical maintenance purposes and will endeavour to inform users of the dates and times of the intervention beforehand.

The pacanalyst.com website is updated regularly. In the same way, the legal notices can be modified at any time: they are nevertheless imposed on the user, who is invited to refer to them as often as possible to take note of them.

The Policy will apply whether you provided the information directly to us or we obtained it from a different source, such as a third party.

3. Description of the services provided.

The purpose of the pacanalyst.com website is to provide information about all the company’s activities.

PAC GROUP endeavours to provide information on the pacanalyst.com site that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies, and shortcomings in the updating, whether they are of its own making or of the making of third-party partners who provide it with this information.

All information on the pacanalyst.com website is given as an indication and is likely to change. Furthermore, the information on the pacanalyst.com website is not exhaustive. It is given subject to modifications having been made since it was put online.

PAC GROUP is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site, in particular the texts, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the site, whatever the means or the process used, is prohibited, except with the prior written authorisation of PAC GROUP.

Any unauthorised use of the site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code.

6. Limitations of liability.

PAC GROUP cannot be held responsible for direct and indirect damage caused to the user’s equipment when accessing the pacanalyst.com site and resulting either from the use of equipment that does not meet the specifications indicated in point 4 or from the appearance of a bug or an incompatibility.

PAC GROUP cannot be held responsible for indirect damage (such as loss of market or loss of opportunity) resulting from the use of the pacanalyst.com website.

Interactive areas (the possibility of asking questions in the contact area) are available to users. PAC GROUP reserves the right to delete, without prior notice, any content posted in this area that contravenes the legislation applicable in France, in particular the provisions relating to data protection. Where applicable, PAC GROUP also reserves the right to hold the user civilly and/or criminally liable, particularly in the event of messages of a racist, insulting, defamatory or pornographic nature, whatever the medium used (text, photographs, etc.).

7. Management of personal data.

In France, personal data is protected by law n° 78-87 of January 6, 1978, the law n° 2004-801 of August 6, 2004, article L. 226-13 of the Penal Code and the European Directive of October 24, 1995.

Your personal information may be shared if we anonymise and/or aggregate it, as in these circumstances, the information will cease to be personal information.

In any case, PAC GROUP only collects personal information relating to the user for the purpose of certain services offered by the pacanalyst.com website. The user provides this information with full knowledge of the facts, in particular when he/she enters it. The user of the pacanalyst.com site is then informed whether or not he/she is obliged to provide this information.

We may disclose your personal information to third parties as follows:

  • Subject to applicable law, in the event that PAC France is merged, sold, or in the event of a transfer of some or all of our assets (including in bankruptcy), or in the event of another corporate change, in connection with such a transaction, or for pre-transaction review in relation to such transactions.

In accordance with the provisions of articles 38 and following the law 78-January 17  January 6, 1978, relating to data processing, files and freedoms, any user has a right to access, correction and opposition to the personal data relating to it by carrying out its request in writing and signed, accompanied by a copy of the title of identity with a signature of the holder of the document, by specifying the address to which the answer must be sent.

The databases are protected by the provisions of the law of July 1, 1998, transposing the directive 96/9 of March 11, 1996, on the legal protection of databases.

We will retain your personal information for as long as required to perform the purposes for which the data was collected, depending on the legal basis for which that data was obtained and/or whether additional legal/regulatory obligations require us to retain it.

In general terms, this will mean that your personal information will be kept for the duration of our relationship with you and:

  • the period required by tax and company laws and regulations; and
  • As long as it is necessary for you to be able to bring a claim against us and for us to be able to defend ourselves against any legal claims. This will generally be the length of the relationship plus the length of any applicable statutory limitation period under local laws.

8. Hypertext links and cookies.

The pacanalyst.com website contains a number of hyperlinks to other sites, set up with the authorisation of PAC GROUP. However, PAC GROUP does not have the possibility to check the content of the sites thus visited and consequently will not assume any responsibility in this respect.

9. Applicable law and jurisdiction.

Any dispute relating to the use of the pacanalyst.com website is subject to French law. Exclusive jurisdiction is given to the competent courts of Paris.

13. Purpose of processing (purpose and legal basis)

PAC France SAS, whose offices are located at 10 rue Treilhard 75008 Paris, has an online sales website. This site allows us to receive orders from our customers, and the data collected on this occasion are recorded and processed in a customer file.

This file allows us to :

Manage orders, payment and delivery.

Carry out marketing operations (loyalty, promotions) and send advertisements by e-mail to our customers who have not objected or who have accepted:

On products similar to those they have ordered.

On other products offered by the company.

To pass on the data of our customers who have agreed to this to our commercial partners to enable them to send them advertising (see below).

Legal basis for processing

Order management: the legal basis for processing is the execution of a contract (see article 6.1.b) of the European Data Protection Regulation).

Sending commercial solicitations by e-mail on products similar to those ordered by customers: the legal basis for the processing is the legitimate interest of the company (see Article 6.1.f) of the European Data Protection Regulation), namely to promote our products to our customers.

Sending commercial solicitations by e-mail on other products offered by pacanalyst.com: the legal basis for the processing is consent (see Article 6.1.a) of the European Data Protection Regulation), as required by Article L. 34-5 of the French Post and Electronic Communications Code.

Transmission of the e-mail address to commercial partners: the legal basis for processing is consent (see Article 6.1.a) of the European Data Protection Regulation), as required by Article L. 34-5 of the French Post and Electronic Communications Code.

Categories of data

Identity: title, surname, first name, address, address, telephone number, e-mail address, internal processing code allowing the identification of the customer, and data relating to registration on opposition lists.

Order data: transaction number, purchase details, purchase amounts, invoice payment data (payments, outstanding payments, discounts), and product returns.

Data relating to means of payment: bank card number, expiry date of the bank card, visual cryptogram (which is immediately deleted).

Data are necessary to carry out loyalty and prospecting actions: purchase history.

Recipients of the data

The customer and billing departments of pacanalyst.com are the recipients of all categories of data.

Its subcontractors, responsible for the delivery of its orders, are recipients of the identity, address and telephone number of our customers.

The e-mail addresses of customers who have agreed to this are made available to our business partners (list of business partners, regularly updated).

Duration of data storage

Data necessary for the management of orders and invoicing: for the entire duration of the commercial relationship and ten (10) years for accounting purposes.

Data necessary for the implementation of loyalty actions and canvassing: for the entire duration of the commercial relationship and three (3) years from the last purchase.

Data relating to means of payment: this data is not kept by pacanalyst.com; it is collected during the transaction and is immediately deleted once the purchase has been settled.

Data concerning the lists of opposition to receive prospecting: three (3) years.

Your rights

If you no longer wish to receive advertising from pacanalyst.com (exercise of the right to object or withdrawal of consent already given), contact us (link to a form for exercising your rights to information technology and civil liberties, setting out the various hypotheses detailed above).
